The Himachal Pradesh Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Amendment Rules, 2021
The Labour and Employment Department, Himachal Pradesh on September 24, 2021, has issued the Himachal Pradesh Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Amendment Rules, 2021 to further amend the Himachal Pradesh Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Rules, 2008. • In Rule 281(1) which specifies “The Board may provide financial assistance for the education of the children of the beneficiary from the Fund at the rates”, has been substituted.

Addition of rules 298, 299, 300, 301 and 302
298 Female Birth Gift Scheme:-The Board may provide a sum of Rs. 51,000/- (fifty-one thousand) only in the shape of FDR which may be given to the beneficiary on the birth of his/her female child (up to two girls), which will be encashed on the completion of eighteen years of the said daughter. If the girl in whose name an FDR has been made, unfortunately, dies before attaining the age of eighteen years, the FDR will be transferred to the third girl child of the beneficiary if any, otherwise the entire amount will be paid to the nominee.
- Mentally Retarded Children Benefit Scheme.—A financial assistance for the care of mentally retarded or handicapped children with disability of 50% and above of a beneficiary @ Rs. 20,000/- per year will be provided to him/her on production of a valid medical certificate issued by the competent authority.
- Widow Pension.—The widow of a deceased beneficiary will be provided a pension of sum of Rs. 1500/- per month after the death of the said beneficiary, provided that she is not employed in any Govt./semi-Government or autonomous body under the Government of India/Government of Himachal Pradesh on regular, contract or daily wages basis.
- Hostel Facility Scheme.—A beneficiary will be provided a maximum amount of Rs. 20,000/- for the expenses incurred by him/her on lodging, boarding and food of his children living in any Hostel. Mukhyamantri Awas Yojna.—A beneficiary who is already enrolled either under Pradhan Mantri Aawas Yojna or Mukhya Mantri Aawas Yojna, will be provided a financial assistance of Rs. 1,50,000/- to build his/her house. ”.

The Draft Delhi Shops and Establishments (Amendment) Rules, 2021

The Labour Department, Delhi on September 24, 2021, has issued the Draft Delhi Shops and Establishments Amendment) Rules, 2021 to further amend the Delhi Shops and Establishments Rules, 1954.
Amendment in the Delhi Shops and Establishments Rules, 1954 are as follows: –
• In Rule 3 which specifies “Form of submitting statement and other particulars”, has been substituted, namely: –
“The occupier of the establishment, within 90 days of the commencement of work of his establishment shall apply for the registration under the Act, online on the Shop and Establishment Portal of Labour Department”.
• In Rule 4 which specifies “Manner of registering establishments and form of registration certificate”, has been substituted, namely: –
“On submission of application online on the Shop & Establishment portal of Labour Department, Government of NCT of Delhi, the registration certificate shall be generated online in Form C”.
• In Rule 6 which specifies “Form and manner of notifying change”, has been substituted, namely: –
“The occupier shall notify any change in respect of any information under sub-section (1) of section 5 of the Act within 30 days after such change has taken place, online, on the Shop & Establishment Portal of Labour Department, Government of National Capital Territory of Delhi”.
• In Schedule I, II has been omitted.
The objection & suggestion will be taken up for consideration, after the expiry of a period of 15 days from the date of publication of this notification in the Delhi Gazette should be addressed to the Additional Secretary (Labour), C-Block, 5, Sham Nath, Marg, Delhi-110054.
Esic provision extended to certain establishments and local bodies in Manipur
A notification of the Government of Manipur vide even number dated 29‘“ December 2020, the State Government in consultation with the Employees’ State Insurance Corporation and with the approval of the Central Government gave notice to is the intention to extend the provisions of the Employees’ State Insurance Act, 1948 (34 of 1948) to Municipal Corporation, Municipal Board, Municipal Council, and other Local bodies controlled by the State Government.
And whereas, no objections and suggestions have been received within the said period of 1 (one) the month of the said notification.
In the exercise of the power conferred by sub-section (5) of Section-l of the Employees’ State Insurance Act, 1948 (34 of 1948), and in supersession of all previous notification issued In this regard, the State Government of Manipur, and in consultation with the Employees State Insurance Corporation and with the approval of the Central Government, hereby extends the provisions of the said Act to the classes of establishment specified in Column (1) and situated within the areas specified in Column (2) of the Schedule in the State of Manipur as detailed below with immediate effect.

Himachal Pradesh Minimum wages Revision W.E.F 1st Apr 2021 declared on 9th Sep 2021

Whereas, the Governor, Himachal Pradesh is of the opinion that the minimum rates of wages in respect of category of workers in the Scheduled employment may be revised with effect from 01-04-2021
And whereas, as per provisions of (Act No. 11 of 1948) clause (a) of sub-section (1) of section 5 read with section 9 of the Minimum Wages Act, 1948, a Minimum Wages Advisory Committee was constituted vide Notification No: Shram (A) 4-2/2018-L, dated 30-07-2020. And whereas, a meeting of the said Committee was held on 14-07-2021 wherein
increase in Minimum wages payable to all the categories of workers in all the 19 scheduled employments were approved and recommednded w.e.f. 01-04-2021
Aadhaar Seeding of Universal Account Number of EPF members for receipt of contributions through ECR for Withdrawal and benefits

As per the provision of Social security code section 142 of the code on social security code which mandates aadhar number seeding to the UAN which was implemented from 1st June 2021 and due to this provision as implemented in the EPFO portal many employees & employer had to face many challenges for seeding the same against the respective uan.
However, considering the challenges faced by the employers & employees in expeditious seeding of Aadhaar in UANs particularly in view of corrections required in Aadhaar data of employees in aftermath of the second wave of Pandemic, the EPFO with prior approval of the Central Government extended the time for mandatory seeding of Aadhaar in UAN for filing ECR up to 01.09.2021 which was communicated vide reference. EPFO Head Office Circular No.WSU/15(1 )2019/ATR/529 dated 15.06.2021
The representations for extension of time beyond 01.09.2021 have been considered and it is noted that overall about 94% of contributory EPF members’ UAN have Aadhaar seeding but there is less percentage of Aadhaar seeding in UANs of contributory members in EPFO’s administrative Zone of North Eastern Region and in a certain class of establishments I industries such as Beedi making, Building & Construction, and Plantation. Since Aadhaar seeding is mandatory for any withdrawals, receipt of contributions in Aadhaar seeded UANs helps members to file online claims to avail withdrawals & file e-nominations without employer’s intervention & avoids delay in withdrawals due to non-seeding of Aadhaar in UAN.

In regards to many obstacles as a face by the Employee & employer the revised date of extension has been revised to 31st Dec 2021, to some of the North East Zone wherein the special category of industries are mentioned like Beedi making, Building & Construction, and Plantation
Now, therefore, considering the foregoing, it is hereby decided as under
- Considering the low Aadhaar penetration in the EPFO’s administrative Zone of North East Region comprising of States of Assam, Arunachal Pradesh, Manipur, Meghalaya, Mizoram, Nagaland & Tripura, time for mandatory seeding of Aadhaar in UAN for filing ECR is extended till 31.12.2021
2. Considering the concentration of establishments in remote localities & in areas affected by insurgency, frequent change in worksites of the workers and other attendant constraints in the Classes of establishments- Beedi making, Building and Construction and Plantation industries (Tea, Coffee, Cardamom, Pepper, Jute, Rubber, Cinchona. Cashewnuts etc.) time for mandatory seeding of Aadhaar in UAN for filing ECR is extended till 31.12.2021.
3. For areas and industries I class of establishments other than above, delay in filing of ECRs for wage months of August 2021 & September 2021 only in respect of EPF members due to non-seeding of Aadhaar in the UANs should not be presumed as employer’s default for levy of penal damages u/s 148 of the EPF & MP Act, 1952.
The 3rd category relates to other than sr No 1 & 2 wherein if any aadhar Pending task is to be complete before 15th October 2021 and we have hardly 35 days to complete the same. For October 2021 ECR we might not be able to file ECR where in UAN are not verified
