From 1st Dec 2018 EPF office will not accept physical EPF claim Forms.In order to enable employees to forward maximum claim through online mode, a few pre-requisites to be observe are as follows: –

Employee should have activated UAN through EPF website, wherein employee’s mobile set will be required for receiving OTP.
For Aadhar Seeding in UAN by employee, through UMANG app employees mobile set will be required for receiving OTP. In Case employer is seeding Aadhar number, the same is to be approved by DSC/ESIGN
The UAN should be linked with Bank Account No & PAN and approved with DSC/ESIGN by employer.
The mobile no. should be the same as given in Aadhar database
The employer/employee should have seeded the Aadhar through EPF website or through UMANG app.
Date of joining of member should have been entered by employer.
Date of exit of member should have been entered by employer especially for final withdrawal cases.
Mobile set should be available with the employee for receiving OTP while filing online claims (same mobile no. as given in Aadhar Database)
Last four digit of the bank account no. should be available with the employee (Same bank account as linked in UAN Database)

In case of mismatch of name as per Aadhar Database vis-a vis office/system record, employer can get online request generated for NAME/DOB change and submit related documents to the office. Presently no facility for upload of supporting documents is provided online.

Employer is required to get UAN activated by employee, through member e-seva. Once UAN is activated, employer needs to approve KYC Data related to Bank Account, PAN and Aadhar at the earliest through DSC/ESIGN. It is to be noted that only Bank Account and PAN seeding with approval by DSC is dependent on employer, but UAN activation and Aadhar Seeding can be done by employee.

Employers are advised to complete the above task of Updation of KYC for all employee’s including those who have left and on priority for those who are still in service.

It is suggested that when employee comes to the employer for claim attestation and forwarding the UAN activation, Aadhar, PAN, Bank Account seeding process should be completed there itself, where after online claim can be submitted by the employee the next day.

Odhisha Minimum Wages have been hike from 1st Oct 2018

1. The minimum rates of wages are all inclusive rates including the basic rates, the cost of living allowances and the cash value of the concessional supply if any of essential commodities.

2. The daily minimum rates of wages shall be inclusive of wages payable for the

weekly day of rest.

3. The minimum rates of wages are applicable to employees employed by contractors also.

4. The minimum rates of wages for disabled persons shall be same as payable to the workers of the appropriate category.

5. There shall not be any discrimination between male and female workers in the matters of payment of minimum wages in any category of employment.

6. (a) “Unskilled” work means work which involves simple operation requiring little or no skill or experience on the job.

(b) “Semi-skilled” work means work which involves some degree of skill or

competence acquired through experience on the job and which is capable of

being performed under the supervision or guidance of a skilled employee

and includes un-skilled supervisory work.

through experience on the job or through training as an apprentice or in a

technical or vocational institute and the performance of which calls for

initiative and judgment; and

(d) “Highly Skilled” work means work which calls for a high degree of

performance and full competence in the performance of certain tasks,

acquired through intensive technical or professional training or practices,

work experience for long years and also required for workers to assure full

responsibility for the judgment or decisions involved in the execution of these

tasks.

7. An adult employee shall work for 08 (eight) hours per day excluding half an hour of rest.

As per notification published by the Telangana Government dated 30th October 2018, the Telangana Government has observed that the General Elections to Telangana State Legislative Assembly,2018 will be held on 07.12.2018 (Friday) in one phase for 119 Assembly Constituencies of 31 districts of the Telangana State and in connection with the conduct of poll a large number of Public Buildings, including Educational Institutions and other buildings will be utilized for the purpose of setting up of the polling stations and distribution centers.

Thus, the Telangana Government has directed that 7th December 2018 shall be declared holiday if there is no holiday under the T.S. Factories and Establishments Act, 1974 (Act No.32/1974) and T.S shops and Establishments Act, 1988

Exemption From Payment Of Late Fee Under Maharashtra Professional Tax

As per circular dated 19th October 2018, the Office of the Commissioner of Professional Tax has clarified that the whole late fee payable by the registered employer in respect of monthly or annual returns pertaining to periods April 2016 to November 2018 is exempted subject to fulfillment of eligibility conditions mentioned, viz. :

(1) Any amount payable as per return should have been/shall be on or before the due date.;

(2) The aforesaid employers should submit the monthly or, as the case may be, annual returns pertaining to the periods April 2016 to November 2018 on or before 31st December 2018. The Office of Commissioner has further clarified that no refund or adjustment against any tax liability shall be allowed where late fee has already been paid

Dear All,

Please find attached herewith The Kerala Shops and Commercial Establishment ( Amendment ) Ordinance, 2018 through which section 3 to 8 of the Act is amended.

Th Important amended provision is as follows

1. All the shops and Establishment can be kept open for all day in a year provided weekly off is complied with.

2. Women employees are permitted to work till 10 PM and after 10 PM in a group of 5 members out of which 2 are female employees without any special permission.

3. Proper sitting facility should be provided while on duty. It is intended mainly for textile sector and other similar industry.

4. Maximum penalty has been increased up to to two Lakhs from ten thousand. Detailed penalty structure appended below
