The Minimum Wages (Karnataka Amendment) Act, 2017

New Amendment under Minimum wages act 1948 of Karnataka 

Government of Karnataka has released the Minimum Wages (Karnataka Amendment) Act, 2017, as per the Amendment Act the Karnataka Government has increased the penalties under the Section 22 and Section 22A of The Minimum Wages Act, 1948

1. Short title and commencement.
2. Amendment of section 20.
3. Amendment of section 22.
4. Amendment of section 22A

2. Amendment of section 20.- In section 20 of the Minimum Wages Act,
1948 (Central Act XI of 1948), (herein after referred to as the Principal Act,-
(i) in sub-section (1), for the words “not below the rank of Labour Commissioner”, the words “not below the rank of Assistant Labour Commissioner” shall be substituted. (ii) in sub-section (4), for the words “fifty rupees” the words “one thousand rupees” shall be substituted.

3. Amendment of section 22.- In section 22 of the Principal Act for the
words “ which may extend to five hundred rupees” the words “which shall not be
less than five thousand rupees but which may extend to ten thousand rupees” shall be substituted.

4. Amendment of section 22 A.- In section 22A of the Principal Act, for the
words “five hundred rupees” the words “ten thousand rupees” shall be substituted

Instructions for Profession Tax Registration Certificate (PTRC) TIN holder, regarding selection of period while making the payment.
 a)            In the SAP-TRM based system PTRC e-returns are linked with the e-payment of respective period. MGSTD is receiving many complaints in respect of the problems faced by the employers while filling PTRC e-return. Major complaints mention that even though the payments are made, the same are not being reflecting in the return.  It is noticed that many employers are making mistake while selecting period at the time of making payment. In this regard it is necessary to clarify provisions of Rule 11 of PT Rules 1975.As per Rule 11 of the Profession Tax Rules 1975; everyemployer whose Annual tax liability for the previous year or part thereof was
i)              below Rs 50,000 shall file annual return for current year.  Such return shall contain details of salary, wages and arrears paid in respect of March of Previous financial year to Feb of current financial year
ii)           Rs 50,000 or above shall file monthly return.  Such return shall contain details of salary and wages including any arrears paid in respect of the month immediately preceding the month to which the return relates.
Example: This illustration is given on the web-site >> Acts & Rules >> Rules >> Maharashtra State …….. Employments Act 1975 >> Rule 11.
An employer pays salary or wages for the month of April on a date during the same month or the succeeding month i.e. May. This payment shall be shown in the return for May to be furnished on or before the 31st May.
Considering the above example, the employer should select / enter period as 1st May to 31st May while making the payments of PTRC for depositing PT deducted from the salary / wages of April of that year.
b)         As per Section 6(2) of the PT Act 1975, every return shall be accompanied by a treasury challan as the proof of payment of full amount of tax due according to the return and a return without such proof of payment shall not be deemed to have been duly filed. Therefore, the PTRC e-returns, where the balance payable is more than zero are not accepted by the system.
Selecting proper period while making payment will resolve the issue of balance payable shown in the draft PTRC e-return.

EPF Online Request in regards to Correction of Name Date of Birth and Gender

Currently if employee wants to correct his/her basic details against UAN the employee and employer are required to submit a joint request to the concerned EPFO filed office for correction of above mentioned basic details of employee.

In order to reduce the paper work and time delay  a new function has been introduce in the member interface in the unified portal for correction of basic details 

Once the member make the request the employer has to verify the same once it is approved & verified the respective changes will reflect in the UAN

Auto transfer of EPF account on change of job

Automatic transfer of employees' provident fund (EPF) while changing jobs will be initiated once first payment in respect of the new employee is received from present employer against the UAN flagged for auto-transfer, the Employees Provident Fund Organisation (EPFO), said in a circular.

The EPFO also mentioned the other necessary functionalities required to carry out auto transfer of EPF on change of job. Here are they

1) Members, whose UAN and aadhaar number is entered and matched by the present employer against the existing details as available against the UAN would be marked for auto transfer

2) The Aadhaar number of the employee must have been seeded and verified against the UAN at the previous establishment level.
3) Member's details like date of joining, date of exit and reAson of exit should be available in respect of previous employment.
4) Member's UAN must have been activated and mobile number must be available.
5) SMS and e-mail will be sent to the member once the auto transfer is initiated.
6) The member can request to stop the auto initiated transfer either online using the "stop auto initiated claim cases" functionality provided in the "track claim status" link under "online services" tab in the member portal or through present employer or by approaching the nearest EPFO Office within a limit of 10 days of receipt of SMS informing the member of auto initiation of transfer request at unified portal
7) If the request to stop the auto initiated transfer against a given UAN is not received within the stipulated 10 days from either of the member, field office or employer interface under unified portal and the member contribution is deposited by the present employer and the same is reconciled, then the actual claim will be generated and made available in concerned field office for further processing

Haryana Contract Labour Act Amendment 2017

There has been amendment under Contract labour Act 1970 in Haryana region.

Amendment 2. In sub-section (4) of section 1 of the Contract Labour (Regulation and of section 1 of Central Act 37 Abolition) Act, 1970 (hereinafter called the principal Act), - of 1970.

Payment of Bonus act Circular from Daman Labour Dept

It was  noticed by the Labour Department, that some industrial establishment/contractors in UT of Dadra and Nagar Haveli are still not paying bonus to the workers in accordance with the provision of the Payment of Bonus Act,1965/ - Payment of Bonus (Amendment) Act, 2015 despite issuing instruction vide Circular No. LEO/ Bonus -1141/2016 dated 28/10/2016 thereby depriving the workers from their legitimate right,various complaints were  often received that workers are paid less than they are statutorily entitled to get.  The act of employers paying less bonus or not paying bonus amounts to blatant violation of the provisions of the Payment  of Bonus Act. 1965 /  Payment of Bonus (Amendment) Act, 2015 and the employers are liable for action.

In this regards, to the same Deputy Labour  Commissioner, Dadra & Nagar Haveli has instructed to all Industrial  establishment and contractors to pay the bonus to their employees /workers as per the Payment of Bonus Act 1965/Payment of Bonus (Amendment) Act 2015. The instructions should be followed scrupulously. Non compliance of the provision of the Act would invite penal action. The employers shall also submit Annual Return in Form “D” under the Payment of Bonus Rules, 1975 immediately after making payment of bonus.

Hence, all the factories and establishments including contractors to which the above Acts applies are requested to ensure that they pay bonus to their eligible workers in accordance with the provisions of the Act.

Introduction of Composite Declaration Form (F-11) & New Transfer Process under EPF Act 1952

Dear all Employers,

In order to streamline the process of transfer as in the unified portal 2.0 as Member & employer both were facing the problem in regards to the same EPFO has introduced a new Form No 11 which is rename as Composite Declaration form No 11 ( F-11) and which is linked to the new transfer Process 

The Central Provident Fund Commissioner by exercising the powers conferred under para 36(7) read along with the provisions of para 34 and 57 of EPF Scheme, 1952 and para 24 of Employees' Pension Scheme, 1995 has ordered the introduction of Composite Declaration Form (F-11) by replacing the existing New Form-11 and the same is enclosed as Annexure

I request all employer to introduce the said changes in the joining formalities.

πŸ‘‰In case the employee already has a UAN, the employer will be required to enter his details through registration of member functionalities on the employer's portal. Since there have been cases of wrong linking of current employment of member with a UAN that does not pertain to him, it would be necessary that the employer shall provide the
following data at this stage:-

a) UAN allotted to him in past
b) Aadhaar No. of the member
c) Name of the member

d) Date of Birth

πŸ‘‰In case, the earlier UAN was Aadhaar seeded and verified, the declaration by the employer of transfer request made by the employee in Form-11 will trigger an auto transfer process which will transfer the accumulations against his previous PF ID to the new PF ID.

πŸ‘‰An SMS informing the subscriber about the proposed auto-transfer will be sent on his registered mobile number. Auto transfer will be completed only after:-
a) The member does not request to stop the proposed auto-transfer (either online, or
through employer or at the nearest EPFO office) within 10 days of said SMS, and

b) The first contribution by the present employer is deposited and reconciled

a) the earlier UAN was not seeded with Aadhaar or
b) UAN was Aadhaar seeded but not verified or
c) EPF transfer from or to an exempted establishment
the member needs to apply for transfer in Form-13 as the existing procedure for physical transfer would be followed.

Failure to furnish Aadhaar will lead to difficulty in transferring of old accumulation into new account and therefore all employers are advised to ensure that the Aadhaar number of transferee is filled in the EPFO portal

Here's An App That Lets You Check Your PF Balance, Pension

With the m-EPF app users can view their monthly credits through the passbook as well their details available with EPFO.


  • EPF pensioners can access disbursement details through mobile app m-EPF.
  • m-EPF lets employees access their EPF account using Unique Account Number.
  • Employers can view remittance details using m-EPF app.

Most employees in the organized sector have an account with the EPFO or Employees' Provident Fund Organisation. The employee provident fund account is meant to offer financial security and stability when the employee retires. Both public and private employees can make  contributions on a monthly basis, and earn interest on their savings. Over the years, the amount in the account turns out to be a huge corpus. Now EPF India has created an app called as m-EPF. It helps employees monitor and operate the EPF account using their  Unique Account Number (UAN) from the comfort of their mobile phone.

The app says that users can view their monthly credits through the passbook as well their details available with EPFO. Similarly, the EPF pensioners have been given the facility to access their pension disbursement details through this mobile app.

The app, which has more than 1 million downloads according to Google Chrome Store, also enables employers to view their remittance details.

This year EPFO has made partial withdrawal easier from provident fund for medical and other purposes like purchase of house, education and marriage of children. For this purpose, the EPFO subscriber is no longer required to submit various certificates or documents.

EPFO has also proposed a loyalty-cum-life benefit of up to Rs. 50,000 at the time of retirement for contributing to the scheme for 20 years or more.

EPFO has also said that its 4.5 crore subscribers and around than 54 lakh pensioners, will now receive payments through electronic or digital fund transfer system only, ensuring quick transfer of funds, easier tracking and reconciliation thereof. The Ministry of Labour in a notification dated May 4, 2017, provided for electronic or digital fund transfer/payment of EPF benefits, pension disbursement and insurance claim. 

EPFO has also launched a housing scheme under which the members can make down payment for a house and also pay EMIs out of their EPF corpus.

Discontinuance of Provident fund Form - 9 in physical form

In exercise of powers conferred on Central Provident Fund Commissioner under paragraph 36(7) of Employees' Provident Funds Scheme, 1952, discontinuance of submission of Form No. 9 in physical form is hereby ordered in respect of all the members joining as well as the establishments being covered on or after 1st October, 2017.

IS Division will make provision for maintenance of Form No. 9 electronically and making it available for various purposes with effect from 1st October, 2017.

Since employee master is available in the system containing all relevant details of the employee viz. name, gender, DOB, DOJ, father's/spouse's name as well as Aadhar & bank details fetched through ECR, submission of Form No. 9 in physical form by the employer can be discontinued. This would boost e-governance for fully electronic settlement of claims and also facilitate the employers in ease of doing business by reducing their paper work.

In view of the above my suggestions is that whenever a new employee is joining the following documents should be mandatory 

1. Aadhar Card ( Name of the employee should be as per aadhar)
2. Pan Card
3. Saving Bank account details (The reason behind giving Saving Bank account will be helpful to the employees if applying through online)

Implementation Of Composite Pension Payment Order Form Effective 20 September 2017

As per EPFO circular dated 15th September 2017, the EPFO has implemented new composite Pension Payment Order which will be effective from 20th September 2017. The composite Pension Payment Order will be issued for all categories of Pensioners except in the case of issue/revision of Pension Payment Order prior to 26.09.2008 which involves either Return of Capital or Commutation or both. In such cases, existing form may be used for PPO. Please refer the notification for the revised form

Revised Form For Authorisation Of Housing Loans From PF Account

In addition to the existing form of Loan now ss per EPFO circular dated 18th August 2017 which was released in continuation to the previous circular dated 21st April 2017, the EPFO has revised the application form for Housing loan by PF members and has also directed the Cash Branch to ensure that generation and disbursal of EMIs in respect of the all claims under para 68-BD( 4) of EPF Scheme, 1952 should be made on the first working day of the month. 

The necessary letter of intimation shall be sent to the lending agency and the member on first working day of the month. Please refer to the revised application form in the notification

Proposed Amendments on Maharashtra Shops and Establishments Act 2017

 Salient Features of the Bill

-Application and registration: Establishments need to register online with uploaded, self-certified documents. This is to be done within 60 days of commencement of business. Closure of an establishment must be communicated within 30 days.

Days and hours of work and rest: Operation of shops is hereby permitted 24 hours/7 days a week. Adults can work for no longer than 9 hours a day/48 hours a week; and for not more than five hours unless given a half-hour break. Spread-over should not exceed 10 hours on any day, and 12 hours in the case of intermittent nature of work.

Women employees: There shall be no discrimination against women in employment, transfer and payment of wages. They shall be made to work only between 7am and 9.30pm. Safety, dignity and honour will be protected at all times, and in the event of working between 9.30pm and 7am, transportation from workplace to home must be provided.

 Overtime: Anyone working beyond permissible limits is entitled to overtime at twice the rate of ordinary wages. Overtime shall not exceed 125 hours over a period of 3 months.

Holiday and Leave: Every worker must be ensured at least one day’s rest (24 continuous hours) in a week. If denied a weekly holiday, a compensatory day off must be given. When working on a day of rest, worker is entitled to twice the rate of wages, and no deduction shall be made on account of weekly holiday. Every employee is entitled to eight day’s casual leave with wages during a calendar year, credited on a quarterly basis. Leave may be accumulated upto 45 days and carried forward. Leave applied for 15 days prior and not sanctioned, when over the 45 day limit may be encashed. Unavailed leave barring casual and festival leave must be paid in full by the employer. 8 paid holidays (against  the earlier limit of 4) are mandatory. While 4 of these are fixed, the rest are to be agreed mutually by employer and workers.

 Health and welfare: Measures for health and safety including cleanliness, ventilation, sanitation, drinking water, first aid, toilet facilities, and canteens when employees are over 100 in number must be made. Where employees are over 50 in number, facilities for a creche must be in place on premises, or in a common establishment within a radius of 1 kilometre.

Offenses: Contravention may attract a fine of upto one lakh, with an added fine of rupees two thousand a day for repeated contravention. Total fine shall not exceed two thousand per worker. Contravention resulting in bodily harm can attract imprisonment for six months and/or fine between 2 and 5 lakhs. Non-submission or furnishing of documents for inspection can attract fine upto 2 lakhs, with a penalty of 1 lakh for each offense if non-compliant.

Introduction Of Self-Declaration Form For Insured Woman Relating To Maternity Benefit Under ESI Scheme

As per ESIC circular dated 18th July 2017, the ESIC has introduced a Self-declaration Form for the Insured Woman. The ESIC had noticed some instances, that the family particulars of IP/IW vary from those available in the IP portal which lead to undue benefit. In order to obviate this issue, it has been decided to obtain a self declaration from the Insured Woman for number of her surviving children as on date of presenting the maternity benefit claim. If there is an inconsistency between the declaration and the particulars on the portal, then 12 week of maternity benefit would be paid immediately from the ESIC Branch. Remaining payment, if any, will be made to Insured woman within 14 days subject to verification. Thus, Insured woman shall now submit self-declaration Form along with claim form No. 19 for the settlement of Maternity Benefit Claim

Any False statement or representation for the purpose of obtaining benefit will be punishable with imprisonment for a term which may extend to six months or with a fine of Rs  2000/- or with both.

ECR Rejection - Revision In Pre And Post Unified Portal -Provident Fund act

As per recent EPFO circular dated 11th July 2017, the EPFO has provided solution to certain challenges that the employers were facing viz. 

(1) Issue of Incorrect Month/ Year was mentioned in ECR - In the EPFO application the provision for ECR Revision (Month/Year) has been provided to revise ECRs where month and year needs to be changed, provided no settlement is made and no PMRPY beneficiary exists. 

(2) Incorrect UAN mentioned in ECR/Double TRRN for the same month - the EPFO has provided Application Version 5.36 for the field offices to reject ECRs or adjust amount or refund the amount to the employer. 

(3) Double Payment made by employer for same month using different TRRN/ Double Payment paid by employer against same TRRN and wants to get refund - the EPFO has stated that the Unified portal has already taken steps to refund the amount to the employer directly to their bank account. 

(4) To refund the amount against amount paid in misc. option - the EPFO has stated that currently misc. payments and receipts are being managed by field office manually. Hence field offices may refund the amount to the employer after verifying the details by preparing a cheque manually. Against this cheque, misc. payment entry in the application software may be made. In the future, Field office may also opt to adjust the amount against the future TRRN using Establishment VDR

EPFO signs MoU with HUDCO under new Housing Scheme of EPF & MP Act-1952

Dr. V.P. Joy, Central Provident Fund Commissioner and Dr. M. Ravi Kanth, CMD HUDCO signed a Memorandum of Understanding (MoU) in the august presence of Hon’ble Minister, HUPA, Shri M. Venkaiah Naidu and Hon’ble Minister of State (Independent Charge), Labour & Employment, Shri Bandaru Dattatreya for facilitating “Housing for All by 2022” at Ministry of Housing and Urban Poverty Alleviation, New Delhi.
By taking one step forward to achieve Hon’ble Prime Minister Narendra Modi’s vision of Housing for all by 2022, EPFO has amended EPF Scheme 1952 vide Gazette notification No. G.S.R. 351(E) dated 12th April, 2017 to provide assistance in acquiring affordable houses to the EPF members by allowing withdrawal from the provident fund to the extent of 90% of the total PF accumulation and also facilitating payment of installment of housing loan. The major objective of this scheme is to assist in building houses for workers integrating with housing programmes of the Central and State Governments.

The salient features of this scheme are:-

1.        Bringing together all stake holders namely, workers, employers, financial institutions & housing agencies to provide workers' need for Housing.

2.         Forming Housing societies for collective action, ten or more members can register a society. Society will arrange housing units from public/private housing providers, apply to the concerned PF office through the society for getting Certificate of Fund & Contribution.

3.         Channelizing the corpus of EPF savings to build affordable housing for the working class, withdrawal of up to 90% of accumulations in members Provident Fund Accounts is allowed.

4.  Banks/Financing Agencies can make use of certificate issued by Commissioner to arrive EMI for withdrawal under Para 68 BD (3) of EPF Scheme.

5.          Full/ Part repayment of loans out of monthly P.F. Contributions.

6.        Eligibility condition relaxed for such withdrawal, now membership period of EPF reduced from 5 years to 3 years. 

7.        Members can av ail interest subsidy up to 2.20 lakh in Credit Linked Subsidy Scheme (CLSS) through Ministry of Housing and Urban Poverty Alleviation through its Nodal Agency HUDCO and National Housing Bank for those members whose annual income is less that the amount specified in Pradhan Mantri Awas Yojna.

8.        Individual housing loan repayment can be done by authorizing EPFO to pay installments directly to the lending agency.

New Certificate of Coverage Form in regards to Indian Worker Going to SSA Country

EPFO has revised the certificate of coverage form in respect of Indian Worker 
( having Indian Passport)  going to work in SSA country 

This revised form will be applicable to all Indian Worker going for work in SSA 
(Social Security Agreement) .

In this Form a Joint Undertaking has been introduce with the EPF Member & Employer that when they are deputed to any SSA  Country Employer will continue to contribute during the posting of this employee while working in SSA country.

ESIC due date changed from 21st to 15th

The Employees’ State Insurance Act, 1948 (34 of 1948), the Employees' State Insurance Corporation, hereby makes the following Regulations further to amend the

Employees' State Insurance (General) Regulations, 1950, namely;

1. This Regulation may be called Employees' State Insurance (General) Amendment Regulation, 2017.

2. In Regulation 31, for the words within “21 days” as they Occur, the words within “15 days” shall be substituted.

3. They shall come into force with effect from the contribution payable for the month of June, 2017 i.e. by 15th July, 2017.

New District Covered under ESIC In Haryana under ESIC 2.0

Under ESIC 2.0 Programee from 1st July 2017 the following district of Haryana are covered

"Whole   district     of  Fatehabad,    Palwal,  Bhiwani,    Charkhi     Dadri,  Jind,  Sirsa, Jhajjar,     Hisar,   Sonepat,    Rohtak,    Mewat   (Nuh),   Mahendragarh,     Gurgaon,   Rewari, Ambala,     Panipat,    Kamal,    Kurukshetra,     Kaithal Panchkula    and   Yamuna    Nagar excluding  the area which  are alread implemented"
